Terms of Service

These Terms of Service ("Terms") govern your use of PostedIn, available at usepostedin.com (the "Service"). The Service is operated by Filip Dębiński, a private individual in Poland running it as an unregistered business activity (działalność nierejestrowana) under Article 5 of the Polish Entrepreneurs' Law of 6 March 2018 ("we", "us"). 1. About the Service

PostedIn is a web application for writing, designing and publishing LinkedIn content with the help of artificial intelligence. In particular, the Service lets you:

• generate posts with AI from a topic and a chosen writing style;
• create and save writing styles;
• generate images and carousels (PDF documents) for your posts;
• draft posts from articles in RSS sources;
• schedule posts and publish them to LinkedIn automatically through LinkedIn's official API.

Features may change over time. The current scope of each plan is described on the pricing page.

2. Your Account

To use the Service, you must create an account with accurate information. The Service is not intended for anyone under 16. You are responsible for keeping your login credentials confidential. Notify us immediately of any unauthorized access to your account. Accounts are personal and non-transferable.

You can sign up with an email address and password or with a Google, LinkedIn or Apple account. Connecting a LinkedIn account is required to start the free trial and to publish or schedule posts.

3. Free Trial, Plans and Payments

3.1 Free Trial

When you connect a LinkedIn account for the first time, you get a free trial of 7 days with 100 credits. No payment card is required, and nothing is charged when the trial ends. The trial is available once per account. Unused trial credits expire when the trial ends. We may refuse or end a trial if we detect abuse, for example creating additional accounts to obtain repeat trials.

3.2 Paid Plans

The Service offers monthly subscription plans: Starter, Pro and Power. Each plan includes a set number of credits per month and LinkedIn publishing and scheduling. Current prices, credit allowances and features are shown on the pricing page. We may offer promotional discounts from time to time. Their terms are shown with the offer.

3.3 Credits

AI features use credits:

• generating a post costs 1 credit, and a carousel generated together with the post is included;
• every other AI action, such as improving a post or generating ideas, costs 1 credit;
• generating an image costs 5 credits;
• regenerating carousel slides with AI costs 1 credit, while rendering and downloading a carousel is free.

Plan credits renew every billing period. Unused credits do not roll over. Credits have no cash value, cannot be exchanged for money and cannot be transferred to another account. Current credit costs are shown in the Service and on the pricing page.

3.4 Billing and Automatic Renewal

Payments are processed by Stripe. Prices are listed in PLN or USD. Subscriptions are billed monthly in advance and renew automatically every month until you cancel. At each renewal, we charge your saved payment method the plan's then-current price. We will notify you by email at least 14 days before a price change. The new price applies from your next billing period, and you can cancel before it takes effect.

3.5 Cancellation

You can cancel your subscription at any time online, in your account settings, without contacting us. Cancellation takes effect at the end of your current paid billing period. You keep access to your plan until then, and you will not be charged again. We do not refund unused parts of a billing period, except where required by law.

3.6 Right of Withdrawal (Consumers)

If you are a consumer, you may withdraw from a paid subscription within 14 days of purchase without giving a reason. To do so, send us a clear statement by email to [email protected].

By purchasing a subscription, you expressly request that we start providing the Service immediately, before the withdrawal period ends, and you acknowledge that you lose your right of withdrawal once the Service has been fully provided. If you withdraw after the Service has started, you pay an amount proportionate to what was provided up to the moment you told us you were withdrawing.

Under Polish law, the right of withdrawal also applies to an individual who concludes the contract in direct connection with their business, where the contract is not of a professional nature for them.

3.7 Taxes

Stripe calculates tax based on the currency of the purchase. For USD (and CAD), tax is not included in the price and is added at checkout. For all other currencies, including PLN, the price shown includes tax.

4. Acceptable Use

You agree to use the Service only lawfully and in accordance with these Terms. You must not:

• generate content that infringes third-party rights, is offensive or unlawful, or is spam;
• use the Service for mass unsolicited messaging;
• violate LinkedIn's User Agreement or publish to LinkedIn accounts you are not authorized to use;
• attempt unauthorized access to the Service's systems;
• resell or commercially distribute access to the Service without our consent;
• overload the Service's infrastructure through automated actions.

5. AI-Generated Content

Content in the Service is generated by AI models from third-party providers (listed in our Privacy Policy) based on your inputs. It may contain errors, resemble content generated for other people, or not fit your needs. We do not guarantee the accuracy, originality or fitness for a particular purpose of AI-generated content. Review and edit all content before you publish it.

You are responsible for the content you publish, including its compliance with the law, third-party rights and LinkedIn's policies. Do not enter confidential information or other people's personal data unless you have the right to share it. As between you and us, we claim no rights in the content generated for you.

6. LinkedIn Integration

Publishing and scheduling use LinkedIn's official API, based on the authorization you grant through OAuth. You can disconnect at any time in the Service's settings or in your LinkedIn settings. You are responsible for complying with LinkedIn's User Agreement. If LinkedIn changes its API or policies, we may have to limit or suspend LinkedIn features. PostedIn is not affiliated with or endorsed by LinkedIn Corporation.

7. Intellectual Property

7.1 Our Rights

The Service, its source code, design, logo and branding are owned by us or licensed to us. You may not copy, modify, distribute or create derivative works from them without our written consent.

7.2 Your Content

You keep your rights in your inputs and in the content you create with the Service. You grant us a limited, non-exclusive license to store, process and transmit that content solely to provide the Service, including sending it to AI providers and to LinkedIn when you publish.

8. Privacy

How we handle personal data is described in our Privacy Policy.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for:

• Service interruptions, errors or data loss;
• AI-generated content or the consequences of publishing it;
• indirect, incidental, special or consequential damages;
• losses arising from LinkedIn policy violations or the suspension of a LinkedIn account.

Our total liability to you will not exceed the fees you paid us in the preceding 12 months.

Consumers: these limitations do not exclude or restrict any rights you have under mandatory consumer protection law.

10. Suspension and Termination

We may suspend or delete your account for breach of these Terms, non-payment, or actions that may harm other users or expose us to legal liability. You may delete your account at any time in settings. Deleting your account cancels any active subscription. Your data is then deleted in accordance with the Privacy Policy.

11. Governing Law and Disputes

These Terms are governed by Polish law. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory laws of the country where you habitually reside. We aim to resolve disputes amicably, so please contact us first. If we cannot reach an agreement, the dispute will be decided by the competent court under applicable law. Consumers may also bring proceedings in the courts of their place of residence where the law allows it.

Consumers may use out-of-court complaint and dispute resolution. In Poland, this includes the Voivodeship Inspectorates of Trade Inspection and district and municipal consumer ombudsmen. The President of UOKiK, the Polish consumer protection authority, keeps a register of authorized bodies at polubowne.uokik.gov.pl. Consumers in other EU countries can contact the competent authority or European Consumer Centre in their country.

12. Customers in the United States

Automatic renewal. Paid subscriptions renew automatically every month at the price shown before purchase (plus applicable tax) until you cancel. The price and the monthly billing cycle are shown before you confirm your purchase.

How to cancel. You can cancel at any time online, in your account settings, without contacting us. Cancellation takes effect at the end of the current billing period, and you will not be charged after that. If you need help, email [email protected].

13. Changes to These Terms

We may update these Terms. For material changes, we will notify you by email at least 14 days before they take effect. If you do not accept the changes, you can cancel your subscription or delete your account before that date. Continued use of the Service after that date means you accept the updated Terms.

14. General

If any provision of these Terms is found to be invalid, the remaining provisions remain in full force. These Terms are the entire agreement between you and us regarding the Service.
